2) Eligibility
You must be at least 17 years old to use the Services and have the legal capacity to enter into these Terms.
3) Changes to the Services or Terms
We may update the Services and these Terms from time to time. When we update these Terms, we will update the Effective Date above. Continued use after changes take effect means you accept the updated Terms.
4) Your Account
If the Services allow you to create an account, you agree to provide accurate information (name/username/email), keep it updated, and protect your credentials.
You are responsible for activities under your account, except where prohibited by law.
5) License and Acceptable Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
5.1 Prohibited Conduct
- Using the Services in violation of law or regulation.
- Interfering with the Services or bypassing security or access controls.
- Reverse engineering or attempting to extract source code except where permitted by law.
- Transmitting malicious code, spam, or abusive content.
- Infringing or violating the rights of others (including IP and privacy).
6) User Content (Photos, Images, and Output)
You may import or capture photos/images to create wallpapers (“User Content”). You retain ownership of your User Content.
- You grant RipiaCanvas a limited license to process your User Content solely to provide requested functionality (e.g., generating and previewing wallpapers).
- You are responsible for ensuring you have rights to use and upload your User Content.
7) Privacy
Information practices are described in our Privacy Policy. By using the Services, you acknowledge that your information will be handled as described there.
8) Intellectual Property
The Services (excluding User Content) are owned by RipiaCanvas or its licensors and protected by law. You may not copy, modify, distribute, sell, lease, or create derivative works except as expressly permitted by these Terms.
9) Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation, unless prohibited by law.
10) Disclaimers
The Services are provided “AS IS” and “AS AVAILABLE” to the maximum extent permitted by law. We disclaim warranties including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee the Services will be uninterrupted, error-free, or completely secure.
11) Limitation of Liability
To the maximum extent permitted by law, RipiaCanvas will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill resulting from your use of the Services.
Our total liability for any claim will not exceed the amount you paid in the 12 months before the event giving rise to the claim (or, if you paid nothing, USD $10).
12) Indemnification
You agree to indemnify and hold harmless RipiaCanvas from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, misuse of the Services, or infringement of any rights of another.
13) Termination
You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, if required by law, or to protect the Services and users. Upon termination, the license ends.
14) Governing Law
These Terms are governed by the laws of the jurisdiction of RipiaCanvas Team’s principal place of business, without regard to conflict of law principles, except where your local law requires otherwise.
15) Dispute Resolution and Binding Arbitration
You and RipiaCanvas agree to resolve disputes through binding arbitration, except where prohibited by law.
- Disputes arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration.
- The arbitration will be conducted consistent with applicable arbitration rules in the jurisdiction of RipiaCanvas Team’s principal place of business.
- Each party bears its own costs unless the arbitrator awards otherwise.
If local consumer protection laws provide additional rights, those rights apply.
16) Miscellaneous
- Severability: If any provision is unenforceable, the rest remains in effect.
- No Waiver: Failure to enforce a provision is not a waiver.
- Entire Agreement: These Terms constitute the entire agreement regarding the Services.
